Background and Experience

Will Newman has been litigating cases on behalf of clients since 2009.  He began his career as a transactional attorney at White & Case LLP in 2008, and then worked in the litigation departments of Hughes Hubbard & Reed LLP and Becker Glynn Muffly Chassin & Hosinski LLP.

He is currently a partner at Oberheiden, P.C.  In addition to his work with that firm, he represents a small group of clients individually.

Before his work as a lawyer, Will studied at Brown University, the New York University School of Law, and the University of Copenhagen.  He also taught technology classes to elementary school students at the Village Community School in Manhattan.

Will knows that litigation is often expensive and burdensome.  And while he cannot make litigation cheap and easy, he identifies inefficiencies and helps clients avoid them.  This is because he has experience working for cost conscious clients and advising them on how to spend time and money on efforts that may meaningfully contribute to their success.  And when a matter requires work beyond what one person can do, he has a network of colleagues and vendors who can help get the job done.

Will’s litigation experience includes:

  • Successfully defending a technology company at a jury trial against a claim of age discrimination.

  • Successfully defending a technology company at arbitration against a claim of wrongful termination.

  • Negotiating a favorable settlement for a chemical exporter in a dispute arising from unpaid invoices.

  • Multiple successful trials arising from disputes over asset purchase agreements and master service agreements.

The Wall Street Journal and the New York Post have cited Will as an authority on legal issues.  He is an associate editor of the American Bar Association magazine, Litigation News, and the author of the litigation blog, Unpredictable.  Will has also won public speaking awards in English and in French.

  • A 2021 article about a federal appeals court decision applying the standards for summary judgment in sexual discrimination employment claims.

  • A 2021 article about a Texas Supreme Court decision that limited products liability claims arising from an asset purchase agreement.

  • A 2022 article about a First Amendment challenge to a West Virginia attorney advertising statute

  • A 2023 article about an appellate court rejection of an arbitration decision procured by fraud.

Will is licensed to practice law in Georgia, New York, Pennsylvania, and Virginia. He is also admitted to practice before each of the federal district courts in those states, as well as the federal district courts in Maryland, New Mexico, the Middle District of Tennessee, and Washington, D.C., and the United States Court of Appeals for the Second Circuit. He also regularly represents clients in disputes throughout the United States with the assistance of colleagues in other jurisdictions.
